OVERVIEW
Welcome to My Music Market ("we", "our", or "us") — a curated online marketplace platform connecting musicians, gear enthusiasts, and sellers of new and used music-related products. We provide the website, mobile services, applications, and tools (collectively, the "Platform") that enable independent sellers to list and sell musical instruments, accessories, gear, and related services.
These Terms of Service (“Terms”) govern your access to and use of the Platform. By using My Music Market, whether as a buyer, seller, or visitor, you agree to these Terms and to our Privacy Policy.
1. ACCOUNT CREATION & ELIGIBILITY
You must be at least the age of majority in your jurisdiction to use My Music Market. By creating an account, you represent and warrant that you are authorized to use the Platform and that the information you provide is accurate and complete. Sellers are responsible for their legal, tax, and shipping obligations.
2. MARKETPLACE ROLE
My Music Market is a third-party marketplace. All sales occur directly between sellers and buyers. We do not guarantee listings, inspect items, or assume liability for transactions.
3. LISTINGS & TRANSACTIONS
Sellers must create accurate listings. Buyers are responsible for reviewing listings prior to purchase. Sales are contracts between buyers and sellers, not with My Music Market.
4. FEES AND PAYMENTS
We may charge sellers fees for listings or transactions. Buyers pay full amounts including taxes and shipping. All fees are non-refundable unless otherwise noted.
5. SELLER RESPONSIBILITIES
Sellers must comply with all legal requirements and uphold marketplace standards, including truthful descriptions, timely shipping, and fair return policies.
6. SHIPPING & DELIVERY
Sellers are responsible for shipping. Delivery times are estimates. Risk passes to the buyer when the item is shipped.
7. INTELLECTUAL PROPERTY
All site content belongs to My Music Market or its licensors. Users may not reuse content without permission. Sellers retain rights to their own images and listings but grant us a license to use them on the Platform.
8. USER CONTENT & FEEDBACK
By submitting reviews, listings, or other content, you give us the right to use it to operate and improve the Platform. Content must be lawful and non-infringing.
9. PROHIBITED CONDUCT
Users may not use the Platform for illegal activity, harassment, fraud, spam, or intellectual property violations. Accounts may be suspended or terminated for misuse.
10. THIRD-PARTY SERVICES & SHOPIFY
My Music Market runs on Shopify. Shopify does not participate in sales transactions. You release Shopify from any claims relating to your use of the Platform.
11. PRIVACY
Use of the Platform is subject to our Privacy Policy. We may collect and share data with partners as part of marketplace operations.
12. DISCLAIMERS & LIMITATIONS
The Platform is provided “as-is.” We do not guarantee error-free operation or product outcomes. Liability is limited to the greater of $100 or the amount paid in the last 6 months.
13. INDEMNIFICATION
You agree to defend and hold harmless My Music Market and affiliates from claims arising from your use of the Platform or violation of these Terms.
14. TERMINATION
We may suspend or terminate accounts at any time. Certain clauses, like intellectual property and indemnification, survive termination.
15. DISPUTES & GOVERNING LAW
These Terms are governed by the laws of the state where My Music Market is headquartered. Any disputes must be resolved in that jurisdiction’s courts.
16. CHANGES TO THESE TERMS
We may update these Terms with notice. Continued use of the Platform after changes constitutes acceptance.
